Return policy
1. General provisions.
1.1. This return policy forms part of the terms of purchase of UAB “Metallum novum” and is read together with them.
1.2. The right to withdraw from the contract within fourteen days applies only to consumers – natural persons acquiring goods for personal needs unrelated to business or profession. Legal entities do not have this right.
2. Right of withdrawal.
2.1. A consumer may withdraw from a distance contract of sale without giving a reason within fourteen calendar days.
2.2. The period runs from the day the consumer, or a person indicated by the consumer, receives the goods. Where one order is delivered in several consignments – from the day the last consignment is received.
2.3. The consumer notifies the Seller of the withdrawal by an unequivocal statement by email to info@rusty.lt or in writing to Marių g. 66, Kaunas, stating the order number, the product, the date of its receipt and the consumer’s contact details.
2.4. The deadline is met if the notice is sent before the fourteen-day period expires.
3. Where the right of withdrawal does not apply.
3.1. Under Article 6.228-10(2)(3) of the Civil Code of the Republic of Lithuania, the right of withdrawal does not apply to contracts for goods manufactured to the consumer’s special instructions – goods which are not prefabricated and which are made on the basis of the consumer’s personal choice or instruction, regardless of whether production has begun – or for goods which are clearly personalised.
3.2. This exception covers most of the Seller’s products, which are manufactured to individual dimensions, shapes, perforation patterns or other instructions of the consumer. The consumer is clearly informed of this in the commercial offer before confirming the order.
3.3. The exception does not apply to prefabricated standard goods sold without adaptation to the consumer’s instructions.
4. Condition of returned goods.
4.1. A returned product must be unused, must not have lost its merchantable appearance and must carry all original labels.
4.2. The product is returned in its original packaging. If the original packaging has been destroyed, the product must be packed so that it is not damaged in transit.
4.3. The consumer is liable for any diminution in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
4.4. The surface of Corten products begins to weather from the first hours of contact with moisture. A naturally formed rust layer is not treated as a diminution in value.
5. Return procedure and costs.
5.1. The consumer returns the goods to the Seller within fourteen days at the latest from the day the withdrawal notice was sent.
5.2. The direct cost of returning the goods is borne by the consumer, except where goods of inadequate quality are returned.
5.3. Oversized goods which by their nature cannot be returned by post are returned in a manner agreed with the Seller in advance.
6. Refunds.
6.1. The Seller refunds all sums paid by the consumer, including delivery costs, within fourteen days at the latest from the day it receives the withdrawal notice.
6.2. The Seller may withhold the refund until the goods have been returned or the consumer provides proof of having sent them.
6.3. If the consumer chose a delivery method more expensive than the cheapest one offered by the Seller, the additional cost is not refunded.
6.4. Unless agreed otherwise, the refund is made to the account from which payment was received.
7. Goods of inadequate quality.
7.1. On discovering a non-conformity, the consumer contacts the Seller within a reasonable time by email to info@rusty.lt, providing the order details, a description of the defect and photographs.
7.2. The consumer may require the product to be repaired or replaced free of charge or, where that is impossible or disproportionate, a proportionate price reduction or termination of the contract with a refund of the price paid.
7.3. Claims regarding non-conformity may be raised within two years of delivery.
7.4. The cost of returning goods of inadequate quality is borne by the Seller.
7.5. This section also applies where the right of withdrawal is excluded under Section 3 of this policy. Custom-made goods carry the same quality guarantee as standard goods.
8. Dispute resolution.
8.1. A consumer first submits a request or complaint to the Seller. The Seller replies within fourteen days at the latest.
8.2. If the consumer’s claim is rejected, the consumer may apply to the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, Lithuania, email tarnyba@vvtat.lt, www.vvtat.lt) or to the courts.
